Rental Agreement & Policies
- NON-SMOKING: CABIN and DECK and YARD, and PROPERTY are ALL STRICTLY NON-SMOKING—INCLUDES SMOKELESS TOBACCO, and E-Cigarettes. Violation of this term will result in termination of occupancy and forfeiture of any unused nightly charges plus Damage/Loss deposit.
- NO ANIMALS: No animals of any kind are allowed on the property at any time. We have many guests who insist on properties where there has never been smoking and/or animals due to severe allergies. Violation of this term will result in termination of occupancy and forfeiture of any unused nightly rental charges plus Damage/Loss deposit.
- SUPPLIES: Upon arrival, the cabin will be furnished with a sufficient supply of toilet tissue, paper towels, napkins, etc. Additional supplies will need to be purchased at the guest’s expense.
Check in Procedures:
You will be sent at email with the code to the lock box to access the key to the front door. In spite of several doors on the property, the front door is the only point of access to the cabin upon arrival. The side door will not be accessible at all.
Please take a moment upon arrival to familiarize yourself with the cabin.
At this time the lake is not accessible for swimming, kayaking or boating. The lake is in an HOA and strict adherence to this is important.
CHECKOUT PROCEDURES:
You DO NOT have to clean anything*—just kindly keep the cabin orderly. Please neatly fold all laundry and just leave it on bed–please do not place clean linens/towels on shelves. Do not worry if you don’t have time to launder the linens/towels–it is NOT required–just a courtesy! Housekeeper does NOT clean BBQ grill or fire pit. If you use any of these items, kindly leave them as you found them. PLEASE DO NOT MAKE UP THE BEDS!
Before checking out of the cabin, please:
- Remove all food from the refrigerator unless it is something that can be used by the next guests (e.g., unopened soda, bottled water, coffee, condiments, etc.).
- Close and lock all windows/doors, turn off fans/lights (PLEASE be sure exterior lights are also off).
- Settings for thermometer:
WINTER: set heat set on 50º with fan on AUTO.
SUMMER: set AC on 85º with fan on AUTO.
- Leave furniture and equipment arranged as you found it.
- Keys must be returned to the lockbox or a $100.00 fee per set will be assessed. Owner is not responsible for items left in the cabin. Please let us know about any problems in the cabin (e.g., appliance not working)—we would like to make corrections during your stay if you are truly inconvenienced.
CANCELLATION:
There will be NO REFUNDS for “Acts of God” (e.g., weather over which we have no control). WE STRONGLY RECOMMEND THAT YOU BUY TRAVEL INSURANCE. Here is a link to VACATION TRAVEL INSURANCE (just one of many: http://www.vacationprotection.com
TERMS OF OCCUPANCY:
The rented property is privately owned, and you agree to indemnify the owner for any damage or loss to the property or its contents that occur during your stay. PLEASE NOTE: ONLY THE REGISTERED GUESTS AS AGREED UPON AT THE TIME OF BOOKING WILL BE ALLOWED ACCESS TO THE CABIN. Occupancy limits/names of occupants apply at all times. Violation of occupancy limits will result in the forfeiture of all monies and termination of occupancy. We reserve the right to inspect the property during your stay for due cause or emergencies. Further you agree to refrain from any activity which interferes with the quiet enjoyment of Swan Lake and its surrounding neighbors as well as any illegal activity. Owner is not liable for failures of any equipment, systems, or appliances, as major repair problems cannot be foreseen. It is very difficult (often impossible) to schedule immediate repairs (just like you experience in your own home) so your patience is appreciated. Please do not rearrange the furniture (including moving interior furniture to deck). A charge will be deducted from your REFUNDABLE Damage/Loss if housekeepers have to re-arrange furniture. NO SMOKING. NO DRUGS. NO UNDERAGE DRINKING. NO USE OF SMOKELESS TOBACCO, NO E-CIGARETTES, NO BURNING OF OILS, NO ANIMALS OF ANY KIND. Any violation of the above will result in immediate eviction with no refund due and your Damage/Loss Deposit will not be refunded.
Sorry, but we do not rent to any groups. We are committed to maintaining a quiet, orderly, smoke-free/drug-free atmosphere for the enjoyment of everyone renting nearby cabins, at home in their own cabins, and folks enjoying Swan Lake.
CASTASTROPHIC EVENTS:
If a catastrophe (hurricane, tornado, earthquake, flood, etc.) or any situation simply beyond our control, impairs the vacation rental, owner is not responsible for finding alternate lodging for the renter or for the renter’s financial losses related to transportation or alternate lodging, nor inconvenience. If, on the day that the rental is scheduled to begin, the property is uninhabitable, or the property is not reachable by the RECOMMENDED means of transportation, or access to the property by visitors has been prohibited by authorities, then the owner will refund the money paid by the renter for the cabin.
There will be NO REFUNDS OR CREDITS FOR EMERGENCY EVACUATIONS. . There will be NO REFUNDS for “Acts of God” (e,g, weather over which we have no control). Whether you own property, run a business, or rent a cabin in Texas, the threat of a tornado, flood, or electrical storm is always present, and we all assume this risk. Therefore, we suggest you consider Travel Protection Insurance to secure your vacation investment and eliminate your financial risk. There will be no refunds of any kind for evacuations. Your safety is first and foremost, but if there is time, please help us secure our property.
The most important trip insurance is Trip Cancellation and Interruption protection. Illness, death, weather, accident, and natural disasters are a few of the many variables that lead to trip cancellation and interruption. Trip Cancellation and Interruption protection protects the customer against these forms of unpredictable situations in the reimbursement of normally non-refundable, vacation payments. Additional travel expenses, such as an extra airline ticket or motel room due to a missed departure, may also be covered if the policy covers the reason. BUILDING MAINTENANCE:
Just like your home, at times the cabin must undergo emergency-type repair and/or maintenance. We will always try to give you notice if we know in advance. Your cooperation and understanding are sincerely appreciated.
LIMITATION OF LIABILITY:
Some activities in which guests engage are especially dangerous and include but not limited to swimming, kayaking, fishing, wading, playing, and hiking. This list is not all-inclusive, but simply points out some of the hazards of vacationing in Texas. Guests may also encounter the following risks: slippery floors, rugs, and stairs, especially when wet, deck/and stairs with spaces between rails (dangerous for little children), precipitous drop-offs in creek or rivers, unfenced creeks, rivers, lakes, faulty electrical/plumbing systems, BBQ grills, etc. Parents with children should be aware of dangerous stairs and steps inside and outside the cabin and on property including pathways and other areas of property where various animals dig holes. Therefore, each guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this cabin and signing the Rental Agreement, you acknowledge that in all events and circumstances, the owner, its officers and employees shall not be liable.
